Commission consults stakeholders on “PED Guideline C-13: Integration of pressure equipment in machines” option

PRESSURE EQUIPMENT DIRECTIVE

BFPA is aware of a possible change in the PED Guideline C-13, initially adopted in 2001 and re-confirmed in 2016 during the review of the PED Guidelines after the alignment of PED in the New Legislative Framework (NLF). Application of the PED in machinery including items of pressure equipment and the applicable conformity assessment process, which includes involvement of a Notified Body if one of the items of pressure equipment is higher than category I.

Changing Note 1 and/or Note 2 of PED Guideline C-13 would have far reaching consequences for the conformity assessment process under the Machinery Directive for a very broad range of products.

The Commission have presented three options.

  • Develop new PED Guideline specifically addressing global conformity assessment for machinery including terms of pressure equipment higher than Category I under PED.
  • Need to ensure coherence with PED Article (1 § 2j) exclusion for machinery
  • Requires PED and MD experts discussion at WPG
  • Modification to Machinery Regulation (MR)
  • Aim at single conformity assessment under MR including global conformity assessment related to:
  • Integration of items of pressure equipment in machinery
  • Protection against exceeding permissible operating limits (pressure)
  • Involvement of a third party (NB under machinery legislation) for high risk machinery products involving items > Category I under PED

The Commission asks all stakeholders to analyse the proposed Options and provide feedback or an alternative proposal by 15 December 2021.
